These Terms & Conditions ("Terms," "Agreement") constitute a legally binding agreement between Biohazard Cleanup Fort Worth ("Company," "we," "us," or "our") and you ("Client," "you," or "your"), governing both your use of our website at biohazardcleanupfortworth.net and the engagement of our biohazard cleanup and related services at 4708 Calmont Ave, Fort Worth, TX 76107.

By using this website, requesting an estimate, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to all of these Terms, please do not use our website or engage our services.

1. Acceptance of Terms

By accessing or using our website, calling our phone number, submitting a contact form, requesting an estimate, or engaging our services in any way, you agree to be bound by these Terms & Conditions and our Privacy Policy, which is incorporated herein by reference.

If you are entering into this Agreement on behalf of a business, estate, property management company, insurance company, or other organization, you represent and warrant that you have the authority to bind that entity to these Terms, and the terms "you" and "your" shall refer to that entity.

These Terms apply to all users of our website and to all clients who engage our services, including without limitation individuals, families, property owners, property managers, landlords, tenants, businesses, government entities, and insurance representatives.

Capacity: By accepting these Terms, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. Our services are intended for adults only.

2. Services Description

Biohazard Cleanup Fort Worth provides professional biohazard cleanup, decontamination, and remediation services in Fort Worth, Texas and the surrounding DFW metropolitan area. Our services include, but are not limited to:

Biohazard Cleanup — removal and decontamination of blood, bodily fluids, and other potentially infectious materials using OSHA-compliant methods.
Crime Scene Cleanup — trauma scene cleanup and decontamination following homicide, suicide, or violent crime, including fingerprint dust removal.
Hoarding Cleanup — compassionate remediation of hoarding situations at all levels (1–5), including biohazard removal and sanitization.
Unattended Death Cleanup — decomposition scene cleanup, odor elimination, and full decontamination following unattended or undiscovered deaths.
Emergency Biohazard Response — 24/7 emergency dispatch for urgent biohazard situations requiring immediate attention.

Scope of Services: Our biohazard cleanup services address decontamination and sanitization. We do not perform general construction, painting, flooring installation, or other general contractor work. If structural restoration is needed beyond biohazard cleanup, we recommend engaging a licensed general contractor in addition to our services.

3. Service Estimates and Pricing

We provide free, no-obligation estimates prior to beginning any service. Estimates are based on our assessment of the scope of work required at the time of inspection.

Free Estimates — all initial estimates are provided at no charge and with no obligation to proceed.
Written Scope of Work — before work begins, we provide a written description of the services to be performed and the estimated cost.
Transparent Pricing — there are no hidden fees. All costs will be disclosed before work begins.
Estimate Accuracy — estimates are based on the information available at the time of assessment. If hidden contamination or unforeseen conditions are discovered during the cleanup that materially change the scope of work, we will notify you and obtain approval before proceeding with additional work.

Scope Changes: If conditions discovered during cleanup are materially different from those assessed at the time of the estimate — for example, contamination discovered beneath flooring or within wall cavities — an updated estimate will be provided before additional work proceeds. No additional work will be performed without client authorization.

4. Payment Terms

Payment for services is due as follows:

Payment Due — payment is due upon completion of services unless alternative arrangements have been made in writing (for example, direct insurance billing).
Accepted Payment Methods — we accept cash, check, and major credit and debit cards. Specific accepted card types will be confirmed at the time of service.
Insurance Claims — if you are filing an insurance claim for cleanup costs, payment arrangements will be discussed at the time of service. We provide complete documentation to support your claim.
Late Payments — invoices not paid within 30 days of the completion date may be subject to a late fee of 1.5% per month (18% per annum) or the maximum rate permitted by Texas law, whichever is less.
Collections — in the event of non-payment, the Client agrees to be responsible for all reasonable costs of collection, including attorney's fees, to the extent permitted by Texas law.

We understand that biohazard situations are often unexpected and financially stressful. If you have concerns about payment, please discuss them with us before services are rendered. We will work with you to find a solution wherever possible.

5. Client Responsibilities

To enable us to perform our services safely and effectively, the Client agrees to the following responsibilities:

Property Access — you must provide legal access to the property where services are to be performed, including any keys, access codes, or permissions required from property owners or authorities.
Authorization — you represent that you are either the property owner or have lawful authority from the property owner to authorize cleanup services on the property.
Accurate Information — you agree to provide accurate and complete information about the nature and extent of the cleanup situation to the best of your knowledge, enabling us to properly assess safety risks and prepare appropriately.
Hazard Disclosure — you agree to disclose any known hazards present at the property that may affect the safety of our technicians, including known or suspected infectious diseases, chemical hazards, structural instability, or the presence of weapons.
Personal Property — you are responsible for identifying and securing any items of personal value or sentimental importance before cleanup begins, particularly in hoarding cleanup situations. We exercise reasonable care but cannot be responsible for the condition of severely damaged or contaminated personal property.
Law Enforcement Clearance — for crime scenes, you represent that law enforcement has cleared the scene and authorized cleanup to begin before our services commence.
Utilities — you are responsible for ensuring that necessary utilities (water, electricity) are operational at the property during service, unless alternative arrangements are made in advance.

6. Limitation of Liability

To the maximum extent permitted by applicable law, the total liability of Biohazard Cleanup Fort Worth to you for any claim arising out of or relating to these Terms or our services, regardless of the form of action, shall not exceed the total amount paid by you to us for the specific services giving rise to the claim.

In no event shall Biohazard Cleanup Fort Worth be liable to you for any:

Indirect damages — including loss of profits, loss of revenue, loss of business opportunity, or loss of anticipated savings.
Consequential damages — damages that arise as an indirect result of our services or their absence.
Incidental damages — arising from any service interruption, delays, or any act or omission not directly within our control.
Special or punitive damages — to the extent permitted by Texas law.

This limitation of liability applies even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain types of damages, so some of the above limitations may not apply to you.

Pre-Existing Conditions: We are not liable for damage that existed prior to our services, including pre-existing structural damage, deterioration of building materials that were contaminated before our arrival, or damage caused by the biohazard incident itself.

7. Disclaimer of Warranties

Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied, except as expressly set forth in a written agreement signed by an authorized representative of Biohazard Cleanup Fort Worth.

To the maximum extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to:

Merchantability — we make no warranty that our services are of merchantable quality or fit for any particular purpose beyond the specific scope of work described in our service agreement.
Complete Elimination — while we strive for thorough decontamination, we cannot guarantee that all trace biological material or odor will be completely eliminated in every circumstance, particularly in cases of severe, long-standing contamination that has penetrated structural elements.
Website Accuracy — while we strive to keep our website content accurate and up to date, we make no warranty that information on our website is complete, current, or error-free.

Our Commitment: While we disclaim implied warranties as required by law, we are deeply committed to delivering high-quality, thorough biohazard cleanup services. 8. Indemnification

You agree to defend, indemnify, and hold harmless Biohazard Cleanup Fort Worth, its officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

Your breach of any representation, warranty, or obligation under these Terms.
Your failure to provide complete or accurate information about the property or the nature of the biohazard situation.
Your failure to disclose known hazards that could affect the safety of our technicians.
Your lack of authorization to grant access to the property where services are performed.
Claims by third parties arising from your use of our services or your misrepresentation of our services.
Your violation of any applicable law or third-party right in connection with our services.

9. Insurance and Claims Assistance

We carry appropriate business liability insurance for our operations. Evidence of our insurance coverage can be provided upon request.

Client Insurance Claims: We understand that many clients seek reimbursement for biohazard cleanup costs through their homeowner's, renter's, or property insurance policy, or through programs such as the Texas Crime Victims' Compensation program. In connection with your insurance claim, we will:

Provide a detailed scope of work and itemized invoice documenting all services performed.
Provide before-and-after documentation (photographs or other records) as appropriate and available.
Complete any additional documentation reasonably requested by your insurance provider related to the services we performed.

Insurance Responsibility: We do not guarantee insurance coverage for our services. Coverage determinations are made solely by your insurance provider based on your specific policy terms. Regardless of the outcome of your insurance claim, you remain responsible for payment of our fees as agreed. We recommend contacting your insurance provider as early as possible to understand your coverage.

10. Cancellation and Rescheduling

We understand that circumstances surrounding biohazard situations can be unpredictable. Our cancellation and rescheduling policy is designed to be fair and flexible:

Cancellation Before Services Begin — you may cancel a scheduled service appointment at any time before our team arrives on-site at no charge, provided you notify us as soon as possible.
Cancellation After Arrival — if you cancel after our team has arrived on-site and setup has begun, a reasonable charge may apply to cover travel, preparation, and materials costs incurred. This will be discussed and agreed upon at the time of cancellation.
Cancellation After Work Begins — if cleanup has commenced, you are responsible for payment for all work completed to the point of cancellation, calculated on a pro-rata basis from the agreed estimate.
Rescheduling — rescheduling requests are accommodated based on availability. We recommend contacting us as early as possible when rescheduling is necessary.
Our Right to Cancel — we reserve the right to cancel or decline services at any time if we determine that conditions at the property pose an unreasonable safety risk to our team, or if the client misrepresented material information about the job.

11. Emergency Situations

We provide 24/7 emergency biohazard cleanup response. In genuine emergency situations where immediate action is required, we may commence services under verbal authorization with written agreement to follow. The following applies to emergency service engagements:

Verbal Authorization — in emergency situations, verbal authorization to proceed is binding and the client agrees to execute any required written documentation promptly upon request.
Emergency Rates — while our standard pricing applies to most emergency situations, any applicable emergency dispatch fees will be clearly disclosed before services begin.
Safety Priority — in emergency situations, the safety of our technicians, clients, and the public takes priority. We may take immediate action to contain biohazards before the full scope of work is formally agreed upon, and will communicate with you throughout.

12. Intellectual Property

Dispute Resolution: Before initiating any formal legal proceeding, both parties agree to attempt to resolve any dispute through good-faith negotiation. Either party may initiate this process by providing written notice of the dispute, and both parties will attempt to resolve the dispute within 30 days of such notice.

Mediation — if negotiation fails, the parties agree to attempt non-binding mediation before any litigation, with costs split equally, unless otherwise agreed.
Limitation Period — any claim arising out of these Terms or our services must be brought within one (1) year after the cause of action arises, to the extent permitted by Texas law.
Severability — if any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
Entire Agreement — these Terms, together with our Privacy Policy and any written service agreement between the parties, constitute the entire agreement between you and Biohazard Cleanup Fort Worth with respect to the subject matter hereof.

14. Changes to These Terms

We reserve the right to update or modify these Terms & Conditions at any time at our sole discretion. We will indicate the date of the most recent revision at the top of this page. Material changes will be announced with reasonable notice where practicable.
